Ukraine’s long and winding road to WTO accession appeared to finally come an end on February 5, 2008, when the World Trade Organization General Council approved Ukraine’s accession package. Ukraine began its march towards accession in 1993, and for 10 long years plodded through bilateral negotiations, legislative changes, commitments, and reports.

August 29-30, 2008 · Meeting of participant organizations from the Transparent Land Public Anticorruption Initiative and Implementation of Transparent and Corruption-Free Land Development Procedures coalitions

USAID|TIBA participated in a meeting of participant organizations from the Transparent Land Public Anticorruption Initiative and Implementation of Transparent and Corruption-Free Land Development Procedures coalitions organized by USAID, MCC, MSI, the Department of Youth Initiatives NGO, and the East-Ukrainian Center of Civil Initiatives. During the meeting, issues of land development, construction, and public anticorruption activities in the sphere of rental of agricultural land were discussed.

 

August 19, 2008 · Meeting of the Permanent Working Group on Land and Real Estate Issues created under the Council of Investors by the Cabinet of Ministers of Ukraine

USAID|TIBA participated in the meeting representing EBA as a member of the Working Group (WG). The WG discussed and agreed to the following agenda for simplifying the permit issuance system in construction: 1) the WG will prepare draft amendments to the existing Draft Law No. 0883 "On Amending Certain Laws of Ukraine Regarding Support in the Sphere of Construction" to improve it prior to the second reading by the Verkhovna Rada, and 2) the WG will improve the Draft Building Code prepared by the Ministry of Regional Development and Construction. The WG also discussed the Draft Law of Ukraine "On Procedures for Approving and Adopting General Plans of Cities" and decided to include provisions on introducing zoning principles to municipal general plans in said Draft Law. Deputy Minister of Regional Development and Construction Anatoliy Tkachuk presented current results of activities of the Quick Deregulation (QD) Working Group under the Ministry and urged private sector representatives to take an active part in the second phase of QD. The meeting results were a positive sign that the GOU is making progress on policy reforms in construction and land sectors.

 

August 9, 2008 · The President of Ukraine signed Decree No. 698/2008 "On Urgent Measures to Improve State Regulation of Economic Activity"

The Decree was signed based on the results of the annual Presidential Forum "Government and Business Are Partners" held on July 3, 2008. The Decree outlines urgent measures to be taken by the Government of Ukraine at all levels as well as by local self-governance authorities in order to accelerate reforms in the sphere of state regulation and remove barriers to business development. The most important measures include the following: 1) ensuring proper implementation of the Law of Ukraine "On the General Principles of State Control (Supervision) in the Sphere of Economic Activity" (the Inspections Law); 2) bringing regulations at all levels of governance into compliance with the Law of Ukraine "On the Permit Issuance System in the Sphere of Economic Activity"; 3) reviewing the current status of and options for reform of technical regulation systems in relevant spheres and issuing corresponding resolutions; and 4) ensuring participation by representatives of local offices of central executive permit issuance authorities in operations of permit-issuing one-stop shops. The Decree orders the Office of the Prosecutor General of Ukraine to conduct inspections to verify compliance by state authorities with the aforementioned Laws and take necessary actions if violations are found.

 

August 7, 2008 · The Draft Law of Ukraine "On Amendments to the Land Code of Ukraine and Selected Legislative Acts" was registered by the Verkhovna Rada of Ukraine

The Draft Law of Ukraine "On Amendments to the Land Code of Ukraine and Selected Legislative Acts" (Registration No. 3044) was developed with assistance from USAID|TIBA with the aim of bringing the aforementioned legislation into compliance with the Permit System Law of Ukraine and removing excessive administrative control over property transactions. These amendments will contribute to efforts by the Government of Ukraine aimed at reducing corruption in the sphere of property transactions and encouraging investment and business development in Ukraine. The amendments should be discussed during the next session of the Verkhovna Rada of Ukraine.

 

July 31, 2008 · Training on the Methodology for Conducting the Second Phase of Quick Deregulation for the Ministry of Culture and Tourism, Ministry for Regional Development and Construction , and State Committee for Land Resources of Ukraine

USAID|TIBA and the State Committee of Ukraine for Regulatory Policy and Entrepreneurship organized a training for experts of the Ministry of Culture and Tourism, Ministry for Regional Development and Construction, and State Committee for Land Resources with the aim of building their capacity to conduct a review of regulatory acts related to the spheres of tourism, construction, and land use. As a result of the review, regulatory acts that create barriers for business development in the aforementioned spheres will be identified and proposals for amending or repealing them will be prepared. During the training, USAID|TIBA ensured that participants obtained the necessary knowledge and skills for conducting the review, analysis, and other relevant activities as required by Cabinet of Ministers Resolution No. 824-p "On Measures to Implement a Review of Regulatory Acts in the Sphere of Land Use, Construction, and Tourism."
