Ukraine’s long and winding road to WTO accession appeared to finally come an end on February 5, 2008, when the World Trade Organization General Council approved Ukraine’s accession package. January 13, 2009 · The Draft Law of Ukraine "On the List of Permit-Type Documents in the Sphere of Economic Activity" passed the first reading by the Verkhovna Rada of Ukraine receiving 396 votes (Registration No. 3224)

The Draft Law was elaborated with USAID|TIBA participation. It establishes an exhaustive list of permit-type documents as defined by law. Adoption of the Draft Law will eliminate opportunities for permit-issuing authorities to define permit-type documents at their own discretion. At present, permit-issuing authorities frequently use the absence of such a list of permit-type documents as a tool to justify their resistance to issuing permits through one-stop shops, arguing that the documents that they issue are not permits and therefore do not have to be issued through OSSs. Once it is adopted, the Draft Law will contribute to reduction of corruption in the permit issuance sphere, help improve operations of permit-issuing one-stop shops, and help reduce time and money spent when obtaining permits. TIBA will be assisting the Verkhovna Rada Committee on Industrial and Regulatory Policy and Entrepreneurship and State Committee for Regulatory Policy and Entrepreneurship in preparing the Draft Law for final second reading.

 

December 25, 2008 · The Executive Committee of the City Council of Khmelnytsky adopted the Resolution No. 1576 "On Establishing the Information and Consultations Center Under the Permit Issuing One-Stop Shop of the Department of Economy"

The Resolution introduced selected procedures and recommendations provided in the USAID|TIBA OSS Toolkit "Recommendations for Streamlining Permit Issuance Procedures in the Sphere of Economic Activity and Construction at the Local Level." The Resolution requires 1) To develop a unified electronic system to provide detailed and accurate information on local permit issuing authorities operations, list of permits issued at the local level and procedures for their issuance; 2) To make this information available through the Information and Consultations Center under the Permit Issuing One-Stop Shop and official web-site of the Khmelnytsky City Council; 3) To regularly update this information. By implementing unified procedures developed by USAID|TIBA, local officials will be able to reduce corruption by improving operations of the permit-issuing one-stop shop and increasing transparency of permit issuance procedures.

 

December 22, 2008 · The Mayor of Konotop (Sumy oblast) signed the Resolution No. 356-p "On Improvement of Permit Issuance Procedures"

The Resolution introduced selected procedures and recommendations provided in the USAID|TIBA OSS Toolkit "Recommendations for Streamlining Permit Issuance Procedures in the Sphere of Economic Activity and Construction at the Local Level." The Resolution requires 1) To conduct a review of all permits issued in the city of Konotop to ensure that they are issued in full compliance with the Law "On Business Permit System". If the review reveals instances of issuing some permits established by local regulations (which is a violation of the Law), the Resolution requires to repeal such local regulations; 2) To make the following information available on the municipal website: list of buildings, premises, and land plots available for rent in the city, list of permits issued in the city through municipal one-stop shop with detailed information on procedures of their issuance; 3) To monitor coordination between permit issuing authorities in the process of issuing permits through municipal OSS and introduce measures to eliminate instances of issuing pernits bypassing the OSS. By implementing unified procedures developed by USAID|TIBA, local officials will be able to improve operations of the permit-issuing one-stop shop.

 

December 19, 2008 · The mayor of Kamyanets-Podil'sky (Khmel'nytska oblast) signed the Resolution No. 1083-p "On Streamlining Permit Issuance Procedures in the Sphere of Economic Activity"

The Resolution introduced selected procedures and recommendations provided in the USAID|TIBA OSS Toolkit "Recommendations for Streamlining Permit Issuance Procedures in the Sphere of Economic Activity and Construction at the Local Level." Adopted procedures focus on 1) increasing transparency and public access to information about permit issuance procedures facilitated by the municipal one-stop shop; 2) conducting on-going monitoring of local businesses' opinion about OSS operations; 3) monitoring coordination between permit issuing authorities in the process of issuing permits through municipal OSS and introducing measures to eliminate instances of issuing permits bypassing the OSS; 4) updating the list of permits issued through municipal OSS and bringing that list in compliance with Permit System Law. By implementing unified procedures developed by USAID|TIBA, local officials will be able to improve operations of the permit-issuing one-stop shop and reduce corruption in the permit issuance sphere as well as the time and money spent by entrepreneurs when obtaining permits.

 

December 19, 2008 · Meeting of USAID|TIBA experts with technical staff of USAID's "Promoting Active Citizen Engagement in Combating Corruption in Ukraine" Project

Alexander Shabalkov, TIBA Senior Legal Expert, and Anna Bogdanova, TIBA Monitoring and Evaluation Director, met with the technical staff of the "Promoting Active Citizen Engagement in Combating Corruption in Ukraine" Project to update colleagues on results and successes of TIBA and elaborate ways to increase synergy between two projects to ensure increased return on USAID investment
